Supreme Court tests Trump immigration enforcement powers
The Court is reviewing ICE detention policy after more than 20,000 lower-court rulings and a 9-2 appellate split rejected the administration’s position. Its emergency ruling allowing third-country deportations without effective advance notice, along with pending cases on bond hearings, birthright citizenship, voting eligibility, and immigration detention, could substantially redefine executive authority and due process. Trump’s attacks on the Court and the administration’s heavy use of the shadow docket add an institutional-legitimacy dimension.
