ESA rule changes and legal challenges

The rollback of the ESA harm definition remains legally contested by Earthjustice and threatens habitat-based protections for listed species, including elasmobranchs. USFWS's move away from blanket Section 4(d) protections toward species-specific rules, alongside concerns about narrowed habitat protections and agency capacity, could make safeguards for threatened species less consistent and weaker.
